1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the WhoAmIVibes application, including our website and mobile app ("WhoAmIVibes", "we", "us", "our", or the "Service"). By creating an account, accessing, or using WhoAmIVibes, you agree to be bound by these Terms, our Acceptable Use Policy, and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and the WhoAmIVibes team.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent and warrant that:

• You meet the minimum age requirements under the laws of your country or region.
• If you are under the age of majority where you live, you have obtained consent from your parent or legal guardian.

If you do not meet these requirements, you must not use the Service.

3. Account Registration

You may register for an account using your email address, Sign in with Apple (iOS app), Google sign-in (website, if available), or similar methods we support. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your information to keep it accurate and complete.
• Maintain the confidentiality of your account credentials.
• Be responsible for all activities that occur under your account.

You must notify us promptly at [email protected] if you believe your account has been compromised or used without your authorization. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect to be fraudulent or abusive.

4. Service Description

WhoAmIVibes provides entertainment-only AI-powered analysis and creative outputs based on photos and images you upload. Depending on the product you select, the Service may include:

• Social persona: Personality-style cards from social profile screenshots.
• Face, palm, and foot reading–style reports from portraits or hand/foot photos.
• Beauty and styling: Personal color boards, makeup and hair/beard look boards, and related lifestyle posters.
• Wellness-style layouts: Posture or yoga lifestyle infographics from body photos.
• Zodiac lifestyle: Illustrated cards and, for some signs, short vertical videos (MP4) with poster images.
• Other themed products we may add from time to time (e.g. MBTI-style cards, aesthetic surgery–style look previews).
• Community features (viewing, liking, sharing generated results you choose to make public), analysis history, and download of generated images or videos where supported.

5. User Content and Uploads

When you upload screenshots, images, or other content ("User Content") to WhoAmIVibes:

• You retain ownership of your original User Content.
• You represent and warrant that you have all necessary rights, licenses, and permissions to upload and use the User Content in connection with the Service.
• You are solely responsible for your User Content and for ensuring that it does not violate any applicable laws or the rights of any third party (including privacy and intellectual property rights).
• You must not upload content that contains personal data of other individuals without their permission.

By uploading User Content, you grant us a worldwide, non‑exclusive, royalty‑free, sublicensable and transferable license to host, store, reproduce, process, adapt, modify, display, and otherwise use your User Content solely for the purpose of operating, improving, and providing the Service (including automated moderation, AI analysis, generating outputs—including video where applicable—and displaying results you choose to share).

We reserve the right, but are not obligated, to remove or disable access to any User Content that we believe violates these Terms or is otherwise harmful.

6. In‑App Purchases and Payments

In‑app purchases (iOS). WhoAmIVibes may offer consumable or one-time in‑app purchases ("IAP") processed through Apple's payment system. By making a purchase in the app, you agree that:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Analysis credits (if applicable) are consumed when an analysis is completed.

Web purchases. On our website (whoamivibes.com), you may purchase analysis plans or credits through our payment partner Creem (when enabled). Payment is charged at checkout. Analysis credits or entitlements are consumed when an analysis is completed unless stated otherwise at purchase.

Pricing and available purchase options may change from time to time at our discretion.

7. Refund Policy

Response time. We aim to respond to all refund and customer support requests within 3 business days. Timely resolution is important to us.

Refunds for purchases made through the Apple App Store are generally handled by Apple according to their refund policies. If you wish to request a refund for an in‑app purchase, please visit reportaproblem.apple.com and follow Apple's instructions.

Completed analyses and consumed credits are generally non‑refundable. However, we may, at our sole discretion, issue refunds or credits in cases such as technical failures or service errors. For any refund or support request, contact us at [email protected].

8. Prohibited Activities and Acceptable Use

You agree not to use the Service in any way that:

• Violates any applicable law or regulation.
• Infringes or violates the rights of others, including privacy, publicity, or intellectual property rights.
• Uploads content that is illegal, harmful, harassing, defamatory, hateful, discriminatory, violent, obscene, or otherwise offensive.
• Uploads or attempts to generate NSFW (Not Safe For Work), sexually explicit, nude, semi-nude, or sexually suggestive content. This includes pornography, sexual acts, suggestive poses, or any content intended to arouse. We use content moderation and API-gated AI models with built-in safety filters to prevent such content.
• Uploads content containing personal data of other individuals without their consent.
• Attempts to reverse engineer, decompile, or otherwise derive the source code of the app or its components.
• Attempts to gain unauthorized access to any part of the Service, other accounts, or our systems.
• Uploads or transmits viruses, malware, or malicious code.
• Harasses, abuses, or harms other users.
• Manipulates or artificially inflates likes, views, or other metrics.
• Uses automated tools, bots, or scripts to access or interact with the Service in a way that could disrupt or overload our systems.

We may investigate violations of this section and may suspend or terminate your account, or take other appropriate measures, if we believe you are engaging in prohibited activities.

9. Intellectual Property Rights

WhoAmIVibes, including its original content, features, user interface, and underlying technology, is owned or licensed by the WhoAmIVibes team and is protected by applicable copyright, trademark, and other intellectual property laws.

You acknowledge that:

• You do not acquire any ownership rights in WhoAmIVibes or its content (other than your User Content).
• We grant you a limited, personal, non‑exclusive, non‑transferable, revocable license to use the app and access the Service for your own personal, non‑commercial use, in accordance with these Terms.
• AI‑generated analysis results are provided for your personal use as described in Section 5. Commercial use of AI‑generated outputs or the Service requires our prior written permission.

10. Privacy and Data Protection

Your use of WhoAmIVibes is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with applicable data protection laws.

By using the Service, you acknowledge our data practices, including processing through Apple, Google (sign-in and Firebase), AI providers (such as Google Gemini and OpenAI), Alibaba Cloud (storage and moderation), and Creem (web payments, when enabled), and the possibility of international data transfers. You can access our Privacy Policy in the Settings section of the app or via our website.

11. AI Analysis Disclaimer

Outputs from WhoAmIVibes are generated by artificial intelligence and are intended for entertainment purposes only. You acknowledge and agree that:

• Results are not scientifically validated psychological, medical, dermatological, surgical, legal, financial, or divination assessments.
• Face, palm, foot, zodiac, posture, makeup, hair, personal-color, or "look preview" outputs are creative and illustrative, not diagnoses or treatment plans.
• Results should not be used for medical, psychological, legal, financial, cosmetic-surgical, or other professional decisions.
• We do not guarantee the accuracy, completeness, or reliability of any analysis results.
• Individual results may vary depending on the content you upload and the limitations of AI technology.
• You are solely responsible for any decisions or actions you take based on the analysis results.

If you have mental health, medical, legal, or financial concerns, you should seek advice from qualified professionals.

12. Service Availability

We strive to provide a reliable Service but do not guarantee that the Service will be available at all times or free from errors, interruptions, or security issues. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

We may, at our sole discretion, introduce, modify, or remove features, or suspend or discontinue the Service (in whole or in part) at any time without prior notice.

13. Third‑Party Services

The Service may integrate or interact with third‑party services, including but not limited to:

• Apple Sign In and Apple in‑app purchases.
• Google Sign In (web, if enabled).
• AI service providers (such as Google Gemini, OpenAI, and other models via our API gateways).
• Alibaba Cloud OSS and Green CIP (storage and content moderation).
• Creem (web payments, when enabled).
• Firebase / Google (analytics and crash reporting).

Your use of such third‑party services may be subject to their own terms and privacy policies. We do not control, and are not responsible for, the content, policies, or practices of third‑party services.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

• We will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, goodwill, or other intangible losses, resulting from:
  • Your access to or use of, or inability to access or use, the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.
• For any claims arising out of or in connection with the Service or these Terms, our total aggregate liability to you will not exceed the amount you have actually paid to us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless the WhoAmIVibes team from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Service.
• Your User Content.
• Your violation of these Terms.
• Your violation of any rights of another person or entity.

16. Account Termination

We may suspend or terminate your access to the Service or your account, at our sole discretion, at any time and for any reason, including but not limited to:

• Violation of these Terms.
• Fraudulent or abusive behavior.
• Requests by law enforcement or governmental authorities.
• Discontinuation or material modification of the Service.

Upon termination, your right to use the Service will immediately cease, and we may delete or anonymize your account data in accordance with our Privacy Policy and data retention practices.

You may also request to close your account at any time through any in‑app account deletion feature (if available) or by contacting us at [email protected].

17. Governing Law and Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with these Terms or the Service, shall be governed by and construed in accordance with the laws of Shanghai, the People’s Republic of China, without regard to its conflict of laws principles.

We encourage you to contact us first at [email protected] to try to resolve any issue informally. If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of Shanghai, China, for exclusive jurisdiction.

18. Changes to These Terms

We may update or modify these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of this page and may provide additional notice within the app (for example, via an in‑app message or notification).

By continuing to use the Service after the updated Terms become effective, you agree to be bound by the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
